Dear Customer,
In this document we would like to inform you about what personal data we process, for what purposes, and whether this happens on the basis of your consent or on another legal ground. You will also find here detailed information about whom we may pass personal data on to and what rights you have in relation to our processing of your personal data.
For the purposes of this document you become a customer at the moment when you book, or intend to book, with us — as the provider and at the same time the controller of personal data (hereinafter the “controller”) — the services offered through the online store at: www.neptunhouseboat.cz (hereinafter the “Online Store”).

DATA PROCESSED BY THE CONTROLLER
We process only the personal data that you provide to us yourself in the course of negotiating the conclusion of a contract and the provision of our services, when completing the booking form through our Online Store, or within our written or electronic communication. We also process personal data obtained while providing our services.
This concerns your identification and contact details (first name, surname, title, address of residence or another contact address), telephone number and email address, as well as the data of third parties with whom you will use our services together and whose data you provide to us in that connection.
We also process billing and transaction data (information about the order, the payment and tax documents).
We further process your personal data obtained during your visit to our Online Store and the forms available there. This concerns cookies and the data entered in the booking form or in other forms available in our Online Store.
We also process data on the use of our services and on purchases made, e.g. records of purchases made, items subject to complaint and your requests, and records of our email, written and telephone communication.
The provision of personal data is entirely voluntary on your part; however, if it is not provided, in some cases we will not be able to provide you with our services or to conclude the requested contract.
PURPOSES OF PERSONAL DATA PROCESSING
We process personal data for the following purposes:
Customer identification, handling and record-keeping of customers’ orders
Without your proper identification we would not be able to provide you with our services, deliver other performance or provide quality customer service. For this reason we need to know who you are. For this purpose we process your identification and contact details.
Legal basis for the processing of personal data:
- steps taken prior to entering into a contract;
- processing is necessary for the performance of a contract;
- processing is necessary for compliance with a legal obligation of the controller.
Customer service, exercise of rights and obligations arising from concluded contracts
We try to set up our procedures and our system of communication with customers so that we always meet all your requirements quickly and efficiently. If you contact us by email, we process records of that communication so that we are able to provide you with the requested answer or a solution to your problem and further improve the customer service we provide. Likewise, when dealing with complaints we keep records of your identification and contact details, billing and transaction data, as well as data on the use of our services and on purchases made, so that we can efficiently satisfy your legitimate claims and also meet our statutory obligations.

Development and improvement of our services, market research
We continuously compare our services and our offer with current market developments so that we offer products in line with the latest market trends, on the best achievable terms and at the same time in compliance with legal regulations. For this purpose we process your identification and contact details, data obtained during your visit to our Online Store and in particular data on the use of our services and on purchases made.

Marketing
We process your identification and contact details and data on the use of our services and on purchases made for marketing purposes: (i) without your special consent, on the basis of our legitimate interest and also under the conditions laid down by the Personal Data Protection Act and the Act on Certain Information Society Services, for the purpose of offering our services and providing an overview of our customer discounts and promotions; (ii) on the basis of your special consent, for the purpose of offers of our services, offers of discounts and of services and goods of third parties, by means of your email, and further for advanced marketing activities, e.g. analyses and combining with other data collected for different purposes, or monitoring your data available on social networks. The customer may withdraw consent at any time.

Establishment, exercise and defence of our legal claims, debt recovery
We may use the personal data you provide in court or administrative proceedings to which we are a party and which concern the legal relationship with you, whether at the request of the competent state authority or on our own initiative when protecting and enforcing our legal claims and receivables.

METHOD OF PERSONAL DATA PROCESSING
We process your personal data both manually and by automated means in electronic information systems, in compliance with the established security and procedural measures. All staff who come into contact with your personal data are duly trained.
We process personal data for as long as the legal ground for their processing lasts, i.e. for the duration of our mutual contractual relationship and until the expiry of the relevant limitation period (usually three years) extended by one year, which relates to the rights arising from or connected with our legal relationship. Personal data processed for marketing purposes are processed until you withdraw your consent to their processing or object to their processing pursuant to Article 6 below.
In order to improve and evaluate the functioning of our Online Store, and also in order to set up some of our marketing activities, we use cookies in our Online Store. Cookies are small text files that are stored locally on your computer via your browser. Cookies make it possible to distinguish individual visitors to the website and thus to personalise its content; they also make it possible to carry out statistical analyses in connection with visits to the website. On your first visit to our Online Store a cookie bar is displayed where you can grant or refuse consent to the individual categories of cookies. The settings can be changed at any time.
TRANSFER OF PERSONAL DATA
We are assisted in the processing of personal data by specialist processors with whom we have concluded a personal data processing agreement and who guarantee the implementation of appropriate technical and organisational measures so that the statutory requirements for the processing of personal data are met and the protection of the rights of data subjects is ensured. Such processors are in particular:
- marketing agencies, in preparing offers of our services;
- providers of IT services and creators of the software products we use in our activities, in particular when carrying out maintenance and changes to our information and sales systems;
- providers of payment services and payment gateways;
- legal and tax advisers, in providing their services (in particular bookkeeping and the defence and establishment of our legal claims).
CUSTOMER RIGHTS IN RELATION TO PERSONAL DATA PROCESSING
In connection with the processing of your personal data you have the following rights:
Right of access
You have the right to obtain confirmation from us as to whether or not personal data concerning you is being processed by us. You also have the right to obtain access to such data. In this connection you have the right to request information about the purpose of the processing, the categories of personal data processed, the recipients of the personal data, the available information about the source of the personal data where it is not obtained directly from you, and the period for which the personal data is stored.
Right to rectification
You have the right to have inaccurate personal data concerning you rectified, or to have incomplete personal data completed.
Right to erasure
You have the right to have your personal data erased where: (i) it is no longer necessary for the purposes stated above for which it was collected and processed by us, (ii) you withdraw your consent to the processing of personal data where your data is processed on the basis of such consent and there is no other legal ground for its processing, (iii) you object to the processing of personal data that is processed on the basis of our legitimate interests and it is found that no such legitimate interests exist any longer, (iv) you object to the processing of personal data for marketing purposes; in such a case the personal data will no longer be processed for that purpose, (v) your personal data has been processed unlawfully, (vi) a binding legal regulation so provides, (vii) the personal data was collected in connection with the offer of information society services to a child.
Right to restriction of processing
You have the right to require us to stop using your personal data for a limited period where: (i) you consider the personal data we hold about you to be inaccurate, (ii) the processing of your personal data is unlawful but you do not request its erasure, only the restriction of its processing, (iii) we no longer need your personal data for the purposes stated above, but you need it for the establishment, exercise or defence of legal claims, (iv) you have objected to the processing of personal data on the ground that legitimate interests for its processing no longer exist on our side.
In the cases under the preceding sentence (no. iv) we will stop carrying out any operations with your personal data until the inaccurate personal data is rectified or its inaccuracy is clarified, or until the outcome of the assessment of your objection to its processing.
Right to data portability
You have the right to receive the personal data concerning you which you have provided to us in a structured, commonly used and machine-readable format, and you also have the right to transmit that data to another controller of personal data.
Right to object to processing
You have the right to object to the processing of your personal data that takes place on the basis of our legitimate interest and for marketing purposes. As regards marketing activities, we will stop processing your personal data upon receipt of the objection; in other cases we will do so unless we have legitimate grounds for continuing such processing.
Right to lodge a complaint
You have the right to lodge a complaint with the Office for Personal Data Protection (Úřad pro ochranu osobních údajů). You may exercise this right in particular if you consider that we process your personal data unlawfully or contrary to generally binding legal regulations. You may send your complaint directly to the Office for Personal Data Protection at the address: Pplk. Sochora 27, 170 00 Prague 7, Czech Republic.
